1. Soft Launch Phase and “As-Is” Service

Vouchfy is currently operating in a Soft Launch or Beta phase. The platform is being tested, improved, and evaluated with early users.

• Beta and Testing Nature: The platform and its services are provided on an “AS IS” and “AS AVAILABLE” basis during the soft launch phase.
• No Guarantee of Availability: We do not guarantee that the platform will always be available, uninterrupted, error-free, or compatible with every device or browser.
• Platform Modifications: We may modify, suspend, restrict, or discontinue any aspect of the platform, including features, access rules, databases, or user functionality, at any time.
• No Prior Notice Required: To the maximum extent permitted by applicable law, we may make these changes without prior notice or liability to you.

2. No Fees or Charges During the Soft Launch

During the current soft launch period, Vouchfy is available without fees, subscription costs, or commissions.

• Referrers may submit candidate details without charge.
• Candidates may claim and accept referrals without charge.
• Recruiters and employers may search, view profiles, and hire candidates without charge.

Future pricing structure

We reserve the right to introduce fees, premium tiers, commissions, subscriptions, or another pricing structure in the future. Any applicable commercial terms will be communicated through reasonable advance notice, such as an email, platform announcement, or updated terms.

3. No Referral Bonuses or Financial Incentives

During the soft launch, Vouchfy does not offer financial payouts, referral bonuses, placement rewards, or monetary incentives for submitting or claiming referrals.

• No user is entitled to a payment for submitting a candidate.
• No user is entitled to a payment for claiming a referral.
• No user is entitled to a placement fee, hiring bonus, or commission through the platform.

The Vouchfy community is designed around professional networks, mutual career growth, and firsthand work validation.

4. User Responsibilities and Acceptable Use

You are responsible for the information you submit, the way you use the platform, and your interactions with other users.

A. Referrers

• Authorization Requirement: You represent and warrant that you have obtained prior verbal or written authorization from a candidate before submitting their name, email address, professional background, or other personal information.
• Honest Representation: You agree to submit skills, background notes, and work-history context honestly and to the best of your firsthand knowledge.
• No Spam or Scraping: Automated spam submissions, bulk submissions, scraping, and submissions generated without a genuine professional relationship are prohibited.

B. Candidates

• Accuracy: You agree that profile data, resumes, employment history, skills, and other information shared when claiming a referral are accurate and legally yours to provide.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

C. Recruiters and Employers

• Fair Use: You agree to use candidate information only to evaluate qualifications for legitimate current or potential employment opportunities.
• No Unauthorized Reuse: You may not download, sell, distribute, or reuse candidate information for unauthorized third-party marketing, spam, advertising, or unrelated commercial purposes.
• Legal Compliance: You are responsible for complying with applicable employment, privacy, anti-discrimination, and data-protection laws.

Prohibited conduct

• Attempting to gain unauthorised access to the platform or another user's account.
• Interfering with the security, operation, or availability of the platform.
• Uploading malicious code, harmful content, or deceptive information.
• Impersonating another person or misrepresenting your professional affiliation.
• Using automated tools to access, scrape, copy, or monitor the platform without written permission.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Vouchfy, its founders, affiliates, employees, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the platform.

This includes, without limitation:

• The accuracy, completeness, or truthfulness of a referrer's recommendation notes.
• Whether a recruiter contacts a candidate, schedules an interview, makes an offer, or completes a hire.
• The conduct, statements, omissions, or decisions of other users.
• Platform outages, service interruptions, or unavailability.
• Lost, corrupted, or unavailable data resulting from updates, maintenance, technical failures, or beta testing.
• Unexpected software errors, including UI, browser, hydration, or rendering issues during the soft launch phase.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

6. Intellectual Property Rights

Platform ownership

All right, title, and interest in and to Vouchfy belong to Vouchfy or its licensors. This includes the website software, source code, database architecture, design layouts, user interface text, algorithms, graphics, workflows, and the network-driven referral-matching method.

Trademarks and branding

The Vouchfy name, logo, icons, slogans, designs, and other branding assets may be protected by trademark, copyright, or other intellectual-property laws. You may not copy, imitate, reproduce, or use our visual branding or trade name without prior written consent.

Limited licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Vouchfy solely for its intended purposes during the soft launch phase. This licence does not grant you ownership rights or any intellectual-property interest in the platform.

User feedback

We welcome feedback, bug reports, and feature suggestions. By submitting feedback, you agree that Vouchfy may use, implement, modify, and commercialise that feedback without restriction, financial compensation, attribution, or other obligation to you.

7. Governing Law and Jurisdiction

Applicable law

These Terms, your use of the platform, and any dispute arising out of or in connection with Vouchfy will be governed by and construed in accordance with the laws of the Sultanate of Oman.

Dispute resolution

Any legal action, suit, or dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of Muscat, Oman. By using Vouchfy, you agree to this venue and jurisdiction to the extent permitted by applicable law.
